What is strict liability for a dog bite?

Strict liability is a legal principle which holds a person or entity responsible for any harm they cause, regardless of whether or not they were actually negligent. In the state of California, dog owners are generally held strictly liable for any dog bite injuries caused by their animals, meaning that even if the owner did not know or have reason to know that the dog would bite, they are still responsible for any resulting injuries. Under California Civil Code Section 3342, owners are liable for any physical injuries their dogs cause, regardless of the dog’s past history or whether or not the owner was negligent in controlling the animal. California also has a “one bite” rule, which states that if a dog has previously bitten someone and the owner was aware of the bite, they are then held strictly liable for any subsequent bites. In addition, California Labor Code Section 3342.5 provides that employers can be held liable for dog bite injuries to their employees if the employee is bitten while performing duties in the scope of their employment. This means that employers can be held accountable even if they had no prior knowledge of the dog’s behavior and regardless of who owns the dog. Ultimately, the law in California provides that owners and employers are held strictly liable when it comes to dog bites and bites from other animals. This means that they can be held liable for any bodily harm their animals cause, regardless of whether or not they knew the animal was likely to bite.
