Is a landlord responsible for a tenant's dog bite?
In Washington, a landlord is not typically responsible for a tenant’s dog bite. Generally, owners are responsible for controlling their animals and preventing them from harming others. Under Washington’s statute RCW 16.08.040, a dog’s owner can be held liable for damages if the dog bites or injures someone, unless the injured party was trespassing or provoking the dog. In some cases, landlords may be held liable under the doctrine of premises liability. If a landlord knows the tenant has a dangerous animal and does nothing to protect others from the animal, the landlord may be responsible for any resulting injuries. Additionally, if a landlord has a “no pets” policy or prohibits certain breeds of dogs, the landlord may be held liable if they don’t enforce the policy and a tenant’s dog causes injury. In general, it is the responsibility of the dog’s owner to keep the animal under control and to ensure that no one is harmed by the animal. Landlords should be aware of the potential risks posed by tenants’ animals and should enforce policies regarding animals in the rental property. If a landlord suspects a tenant has a dangerous animal, they should take steps to protect others, such as requiring proof that the animal is properly licensed, fenced, or put away.
