What is the legal definition of a dangerous dog?

In Texas, a dangerous dog is legally defined as a dog that, without provocation, makes an unprovoked attack on a person causing bodily injury and occurs in a place other than an enclosure in which the dog was being kept, or the dog has continued to act in a manner that causes a person to reasonably believe that the animal will attack and cause bodily injury to that person. A dangerous dog could also be a dog that has been the subject of either two or more separate occasions within the past 36 months in which the owner of the dog received a warning from animal control authorities about the dog’s aggressive behavior, or the owner has been notified by animal control authorities that the dog is a potentially dangerous dog, and the dog must be registered as such. In addition, a dangerous dog can also be defined as a dog that, without provocation, kills or causes serious injury to a domestic animal that is outside the enclosure of the owner and not in the immediate possession of an owner. Under Texas state law, owners of potentially dangerous and dangerous dogs must comply with certain regulations regarding the dog’s confinement and registration. Owners who fail to comply with regulations may face criminal prosecution or civil liability for damages caused by their dog’s aggression.
