What types of orders can a court issue in a domestic abuse case?

In North Carolina, a court can issue civil or criminal orders in a domestic abuse case. Civil orders are issued to protect the victim from further abuse and harassment by the perpetrator. These orders require the perpetrator to cease all contact with the victim, including in-person, telephone, electronic or third-party contact. In addition, the court can order the perpetrator to stay away from the victim’s residence, place of employment, school and other places frequented by the victim. Criminal orders are issued to punish the perpetrator for the abuse. This type of order could include the perpetrator being required to pay financial restitution to the victim, or serve a period of incarceration. In some severe cases, the court may order the perpetrator to be electronically monitored at all times or generally restrict their movement and activities. Furthermore, the court may issue an order for the perpetrator to attend counseling or treatment programs for addiction, substance abuse and/or mental health issues. In some cases, the court may order the perpetrator to receive a mental health evaluation to ensure they are capable of safely caring for, or having contact with, their children. The court may also issue an order requiring the perpetrator to provide financial support to the victim and/or their children if applicable. This could include paying for medical expenses, rent or mortgage payments, child support, and other necessary expenses. Ultimately, the court can make any order it deems necessary to protect the victim in a domestic abuse case. The order is tailored to the individual case and could include any combination of the orders mentioned above.
