If an abuser is subject to a restraining order in California, they must take the order seriously and do their best to comply with it. Failure to do so can result in arrest and/or fines. To help avoid any violations of the restraining order, an abuser should adhere to the following safety measures. First, an abuser should make sure they know the exact terms of the restraining order. This includes understanding what activities and interactions with the victim are allowed and what activities would be considered violations. If anything is unclear, an abuser should seek clarification from a lawyer or other legal representative. Second, an abuser should always keep their distance from the victim. This includes all physical contact, and any communications, whether in person or through other means. It is also important to avoid areas where the victim might be. If the victim uninvites the abuser from a particular place, the abuser should not enter that place. Third, if the abuser knows the whereabouts of the victim they should avoid places where the victim is likely to be. This is especially important when restraining orders include an order for the abuser to stay away from the victim’s workplace and/or residence. Finally, the abuser should be very careful to fully comply with any restraining orders. Ignorance of the law is no excuse for not following it.
