Can an abuser still contact their victim through a restraining order?

In Maryland, the answer to this question depends on what type of restraining order the victim has obtained. Generally, if a victim has obtained a Protective Order, an abuser cannot contact the victim in any way, including through phone calls, texts, emails, or social media messages. The Protective Order prohibits the abuser from coming near the victim or the victim’s family and from communicating with the victim in any way. If an abuser violates the terms of the Protective Order, they can be arrested and face criminal charges. On the other hand, if the victim has obtained a Peace Order, the terms associated with the order will depend on the discretion of the court. In some cases, the court may allow the abuser to contact the victim through email, mail, text message, or phone. However, the abuser must abide by the terms of the Peace Order and cannot contact the victim if it puts the victim in any kind of danger or if the contact is intended to harass, intimidate, or threaten the victim. Violating the terms of a Peace Order can result in jail time or fines. In all cases, an abuser should not contact the victim and it is best for the victim to avoid any contact with the abuser. If the abuser does contact the victim, the victim should document the contact and contact the police if necessary. It is important for victims of domestic abuse to know their rights and to seek legal help when needed.
