Can an abuser still contact their victim through a restraining order?

In New Mexico, a restraining order does not completely prevent an abuser from contacting their victim. If an abuser is served with a restraining order, they are generally not allowed to contact their victim in any way. However, they may still contact the victim through another person, such as a family member or friend. This is referred to as “indirect contact” and it is still considered a violation of the restraining order. Additionally, if the abuser is using any type of electronic device to contact the victim, such as a phone or computer, that also violates the restraining order. Restraining orders in New Mexico can also include language that explicitly states the abuser cannot contact the victim in any way. If this language is included, then it is illegal for the abuser to contact the victim via any method. If this language is not included in the restraining order, the victim can contact the court to add it. Breaking a restraining order in New Mexico is a criminal offense that can result in jail time and steep fines. Victims of domestic abuse should take all threats of violence seriously and consider seeking a restraining order if appropriate. A restraining order is one way to protect oneself and hold an abuser accountable for violating the terms of the order.
