What are the limitations of a restraining order?

A restraining order is a court order issued in Florida to provide protection to a victim of domestic abuse. Restraining orders are designed to prevent an abuser from continuing to hurt or threaten the victim. However, there are limitations to what a restraining order can and cannot do. For example, a restraining order cannot physically stop an abuser from coming close to the victim. If the abuser violates the restraining order, it is up to law enforcement to take action. Also, a restraining order can only be in place for a certain amount of time. A permanent restraining order can be issued in Florida, but only after the abuser has been convicted in a criminal proceeding. The duration of temporary restraining orders, also known as injunctions, is typically one year or less. Furthermore, restraining orders can’t stop an abuser from contacting the victim through more indirect means, such as by email or text messages. A victim must obtain a No-Contact Order from the court if they want to protect themselves from indirect contact from the abuser. A restraining order can also do nothing to keep an abuser from continuing to commit acts of domestic abuse at other locations or with other people. It also doesn’t require the abuser to attend any kind of counseling or anger management classes. Finally, a restraining order can’t guarantee the safety of the victim or their children. It is still important to take safety precautions if a restraining order is in place.
