What is defective products law?
Defective product laws in Georgia are designed to protect consumers from dangerous or defective products that are purchased and used. Defective Product laws can be both state and federal. On the federal side, the Consumer Product Safety Commission has the authority to regulate the safety and labeling of products sold in the US. The Georgia State Department of Consumer Protection handles state consumer protection laws. In Georgia, defective product laws focus on product liability and negligence. Product liability is when manufacturers or sellers are responsible for any defects in their products. Manufacturers may be sued for defective products if they fail to warn consumers of potential safety hazards or of the need for regular maintenance. Negligence is a legal theory whereby a manufacturer or seller can be held liable for injuries caused by their defective product. In order to prove that the manufacturer was negligent, one must show that they had failed to exercise reasonable care in designing, manufacturing, labeling, or marketing the product. Defective product laws in Georgia also provide for punitive damages, which are damages awarded to the plaintiff or plaintiffs that exceed the amount of actual losses. Punitive damages are awarded in order to discourage manufacturers from engaging in dangerous practices that could result in injury or damage to consumers. In the event that a manufacturer or seller is found liable for an injury caused by a defective product, the victim may seek damages in court, including medical expenses, lost wages, pain and suffering, and punitive damages.
