How long do I have to bring a product liability claim?

In Indiana, consumers generally have two years from either when the product was purchased or when the problem or injury occurred to bring a claim for a defective product. This is known as the statute of limitations. So, if the product was purchased two and a half years ago and the injury occurred one and a half years ago, the consumer has two years from when the product was purchased to file a claim. If the consumer is filing a wrongful death claim, then they have two years from the date of the death to bring a claim. The two-year limitation period also applies to claims of misrepresentation or fraud. In certain cases, however, the two-year timeline may not apply. For example, if the injury was caused by a product that was recalled or that had a hidden defect, then the consumer may have more time to file a claim. Additionally, if a consumer is bringing a claim against a manufacturer who is a minor, then the consumer may have up to seven years from the date of purchase to bring a claim.
