What is the difference between a defense of insanity and a diminished capacity defense?

A defense of insanity and a diminished capacity defense are two different defenses in the Kansas Drug Crimes Law. A defense of insanity is based on the fact that the defendant cannot understand that what they are doing is wrong. In order for this defense to be successful, the defendant’s mental capability must be seriously diminished. This means the defendant must not be able to recognize the difference between right and wrong when committing the crime. A diminished capacity defense is based on the fact that the defendant has a mental impairment, but is still able to recognize the difference between right and wrong. The defendant must prove that they were unable to form the intent required to commit the crime due to this impairment. Additionally, this defense must be related to the crime in some way. In both cases, the defendant must prove to the court that they could not understand the consequences of their actions when the crime took place. If the court decides that the defense is successful, the defendant may be found not guilty or face a reduced sentence.
