When is an appeal possible in a drug case?

In Kansas, a defendant may appeal a drug crime conviction if they believe their rights were violated during the trial or if they believe their sentence is unjust. To file an appeal, the defendant must first file a Notice of Appeal with the court where the conviction took place. The Notice of Appeal must include the reasons why the defendant believes their rights were violated or their sentence is unjust. An appeal must be filed within 30 days from the date of the final judgment and sentence of the conviction. If the defendant is incarcerated, the 30-day period begins on the date of the judgment and sentence. After the Notice of Appeal is filed, the defendant must present their arguments to the court in writing, or through a lawyer if they retain one. After the defendant files their Appeal, the court hears arguments from each side and then renders a decision. If the court decides in favour of the defendant, the conviction is overturned and the case is sent back to the original court for a new trial or different sentencing. If the court decides against the defendant, the conviction will remain in place.
