What is Disability Planning Law?

Disability Planning Law is a set of laws that provide for the planning of an individual’s future and protecting the person’s financial resources in the event of a disability. This law is important in Virginia, as it allows individuals to prepare for their incapacity and to protect their assets from being used up to cover the costs associated with their disability. Under this law, individuals can use a variety of tools to ensure that their financial resources are protected in the event they are unable to care for themselves due to a disability. These methods may include setting up special trusts in which all of the person’s assets are placed, or assigning a legal representative who can handle all of their financial affairs if the individual becomes disabled. In addition to setting up trusts and assigning legal representatives, the Disability Planning Law allows individuals to make decisions in advance about who will take care of them in the event they are unable to care for themselves. This is known as an advanced health-care directive, which sets out the person’s wishes concerning medical care, who will make decisions on their behalf, and other matters. By utilizing disability planning law, individuals can plan for their own disability, thus allowing them to protect their financial resources and, when applicable, make sure their wishes are honored regarding medical care.
