What is a Letter of Intent?
A Letter of Intent (LOI) is an important document in Disability Planning Law in North Dakota. It is a document used to make a statement of future goals and intentions regarding the care and protection of a person with a disability. It is used to plan for the long-term needs of the person with a disability, such as living arrangements, guardianship, asset protection, and estate management. A Letter of Intent is usually written by the person with a disability or their parent/guardian, and is typically used when an individual is unable to communicate their own wishes. It is a way to ensure that the wishes of the person with a disability, or their parent/guardian, will be fulfilled. This document can also be used to express the wishes of the person with a disability or their parent/guardian in the event of their death. A Letter of Intent should be carefully planned and written, as it can be used by the court in a guardianship or disability case. It should specify the specific wishes of the person with a disability or their parent/guardian regarding care, housing, assets, and in the event of their death. It is important to note that a Letter of Intent is not legally binding and does not replace a will or guardianship order. However, it can provide important information for the court when making decisions regarding the wishes and needs of the person with a disability.
