How does the Social Security Administration (SSA) determine disability?
The Social Security Administration (SSA) uses a five-step process to determine disability in Georgia. This process is designed to help individuals who have a disability and are unable to work. The first step in determining disability is to determine whether or not the individual is engaging in substantial gainful activity (SGA). If an individual is performing SGA, then they will not be considered for disability benefits. The second step is to determine if the individual has a “severe” impairment. This includes any physical or mental impairments that significantly limit an individual’s ability to work. The third step is to determine if an individual has an impairment that meets or medically equals one of the listed impairments in the SSA’s Listing of Impairments. If the individual’s impairment meets or medically equals one listed, then they will be considered disabled. The fourth step is to determine if an individual can return to their previous job. If they cannot return to their previous job, then the SSA will look at their age, work experience and educational background to determine if they can adjust to another form of work. The fifth and final step is to determine if an individual can perform any other type of work. If an individual cannot, then they will be considered disabled. Disability benefits are available to those who meet the criteria determined by the SSA. It is important to note that the requirements can be complex, so individuals should consider consulting a disability lawyer to help them with their application.
