What is the Family and Medical Leave Act (FMLA)?

The Family and Medical Leave Act (FMLA) is a federal law that was enacted in 1993 to give employees job security while they take time away from work to care for themselves or a family member with a serious health condition. Under this law, workers can take up to twelve weeks of unpaid leave, and employers are prohibited from discharging or discriminating against them for taking such leave. The FMLA covers all businesses in Florida that have 50 or more employees, and it applies to employees who have worked for at least 12 months and 1250 hours in the past year. In addition, FMLA only applies to employees who are dealing with a serious health condition, who are caring for someone with a serious health condition (such as a spouse, child, or parent), or who need to take care of a newborn or newly adopted child. Employees are required to provide their employer with 30 days advance notice before taking leave, unless it is an emergency situation. Employees are also given the right to return to their job, or an equivalent job, at the same pay and benefits at the end of the leave period. FMLA provides valuable protections for employees in Florida, since it enables them to take leave without having to worry about job security. This is especially important for those who have family members with disabilities or other serious medical conditions. The act also provides a sense of security to employees, knowing that their job will be there for them when they are ready to return.
