What is a hearing before an administrative law judge (ALJ)?

A hearing before an administrative law judge (ALJ) is a formal legal hearing held to determine if a person is eligible for disability benefits in Nevada. The ALJ, or judge, listens to both the person seeking benefits and the Nevada Division of Disability Services (DDS) which is tasked with making disability benefits decisions. At the hearing, the ALJ will review all of the information that has been presented by both parties and ask questions if needed. The ALJ will then make a decision on whether the claimant is eligible for disability benefits. The claimant and the DDS have the right to appeal the decision if it is not in their favor. A successful hearing before an ALJ is important because it determines whether or not a person will receive the disability benefits they have requested. The hearing provides the opportunity for both parties to present their case in a fair manner and ensure that the decision is based on facts. Additionally, the ALJ will review any medical evidence that may be relevant to the disability claim and consider how the disability has impacted the individual’s ability to work. It is up to the ALJ to make a final decision on whether the person is disabled and eligible for benefits, so the hearing process should be taken seriously.
