What is a DUI/DWI?
A DUI/DWI is an acronym for “driving under the influence” or “driving while intoxicated.” This is a crime in South Dakota that typically refers to operating motorized vehicles while under the influence of drugs and/or alcohol. A DUI/DWI can be charged even if the driver’s blood alcohol content (BAC) is below the legal limit of .08%. This is because impairment from drugs and/or alcohol can still be a factor in driving capabilities, even if the driver’s BAC is lower than the legal limit. In addition to considerations of BAC, South Dakota law also considers impairment in judging DUI/DWI offenses. Any driver who is visibly impaired (for example, having watery or bloodshot eyes or exhibiting slurred speech) will likely be arrested for driving under the influence. If a person is convicted of a DUI/DWI in South Dakota, it may result in legal fines, license revocation, and even a jail sentence. The severity of the punishment will depend upon the circumstances of the offense, as well as the criminal history of the offender. In South Dakota, a DUI/DWI conviction can also result in a temporary suspension of the driver’s license. If the driver is found guilty, the temporary license suspension will start 45 days from the date of conviction. Additionally, the driver may be required to attend a mandatory DUI/DWI Education Program. Driving under the influence of drugs and/or alcohol is a serious offense in South Dakota. Therefore, it is important to understand the definition of a DUI/DWI and the potential consequences that may result from the violation.
