What is an administrative license suspension?

An administrative license suspension (ALS) is a form of penalty for those who violate DUI laws in Florida. It is a suspension of an individual’s driver’s license by the state, without the need for a court hearing or trial. At the time of being pulled over, if the officer suspects DUI, then he or she will take the driver’s license from them and issue a notice of suspension. This action is taken without considering the outcome of a court trial. The suspension can vary in length depending on the individual’s circumstances. For a first time offender, the suspension usually lasts for six months, however if the driver refuses to take a breathalyzer test then the suspension may last up to 18 months. A second offense can result in an even longer suspension of up to 18 months. ALS can also be appealed. If the suspension is not challenged, then it is upheld, meaning the license will remain suspended for the duration specified by the officer.
