What is an administrative license suspension?

An administrative license suspension (ALS) is a penalty imposed on a driver in the state of Maine who has been convicted of driving under the influence (DUI) of alcohol or drugs. A suspension under this law can occur even if the driver has not been formally charged with a DUI offense or even convicted of one in court. When a driver is pulled over and suspected of DUI, they may be asked to submit to a breathalyzer test. If they are found to be above the legal limit, their driver’s license will immediately be revoked and an ALS will be imposed for a period of 90 days. This will cause the driver to be unable to operate a motor vehicle for the duration of the suspension. The driver may also be required to pay a fee of up to $500 and attend a driver alcohol education program. After the 90 day period has lapsed, the driver may have their license reinstated or they may be required to have an ignition interlock device installed in their vehicle. In addition to the immediate driver’s license suspension, the driver will also face criminal charges if convicted of a DUI offense in court. These charges can vary depending on the severity of the offense and can include fines, jail time, or a license revocation of up to two years.
