What is an administrative license suspension?

An administrative license suspension (ALS) is a law in Maryland that automatically suspends a person’s driver’s license when they are arrested for DUI (driving under the influence). After an individual has been arrested and given a breath, urine or blood test, if they are found to have a BAC (blood alcohol concentration) of .08 or higher, their license will immediately be suspended for 45 days. During this suspension, the individual is not allowed to drive for any reason. The individual must also appear in court for a hearing where a judge will decide whether or not to extend the suspension for up to a year. If the individual does not appear in court, their license will remain suspended for the full 45 days. During the suspension period, drivers are not able to obtain a temporary license or restricted license, meaning they cannot drive for any purpose. In addition to the ALS, an individual may face other serious criminal penalties for a DUI conviction such as jail time, fines, and a loss of driving privileges for up to a year or more. It is important for individuals to understand the seriousness of DUIs and to take steps to prevent them from happening in the first place.
