What is an administrative license suspension?

An administrative license suspension is a type of punishment for those found to be driving under the influence (DUI) in North Carolina. Under the state’s implied consent law, all motorists are considered to have agreed to a chemical test to determine their blood alcohol content (BAC) if a law enforcement officer has reasonable grounds to believe they are impaired while driving. If a driver’s BAC is found to be above the legally allowed level, they will be subject to an administrative license suspension. The length of this suspension will depend upon the specific details of their case, but can last from 24 hours to six months. In addition to the automatic suspension, a driver may also need to appear in court to face further penalties, which could include fines, community service, and even jail time. The purpose of an administrative license suspension is to act as a deterrent and prevent people from driving while impaired. It also serves to ensure the safety of other motorists on the road who might be affected if someone drove under the influence. If a driver does choose to violate the penalties associated with DUI, they could face additional penalties, such as loss of driving privileges or even an increase in insurance premiums.
