What is an administrative license suspension?

An administrative license suspension (ALS) is a type of suspension issued by the state of Pennsylvania without a court hearing or conviction for Driving Under the Influence (DUI). It is an immediate suspension of the driver’s license, which generally lasts for a period of 90 days, but may be extended in some cases. In Pennsylvania, an administrative license suspension is imposed upon a driver for one of two reasons. First, if the driver refuses to submit to a chemical test (breath, blood or urine) after being arrested for DUI, the driver will automatically have their license suspended by the state. Second, if the driver submits to a chemical test and fails it, the results of the test will be sent to the state, and the license will be suspended. The ALS is an administrative penalty, and is separate from any criminal charges that may be levied against the driver for the DUI. It is not an indication of guilt, but is imposed to discourage drivers from operating a vehicle while their ability to do so safely is impaired. Pennsylvania’s ALS program also offers the option for drivers to obtain an Occupational Limited License, or OLL, to be able to drive to school, work, medical appointments, and similar activities. In other words, an administrative license suspension is an immediate, administrative penalty imposed by the state of Pennsylvania upon a driver who fails a chemical test or refuses to submit to one after being arrested for DUI. The suspension may last for up to 90 days and may be extended in some cases. Drivers may be able to obtain an OLL to be able to drive to and from certain places.
