Can I expunge my record for a DUI conviction?

In Washington State, the possibility of expunging a DUI conviction can depend on the circumstances of the case. If you were convicted of a first-offense DUI, the court has the discretion to grant an expungement either at the time of the initial conviction or at a later date. Generally, you must wait at least three years after the conviction to be eligible for an expungement. If the court decides to expunge the conviction, it will be considered a “withhold of adjudication” which means that the conviction will not appear on your criminal record. If you were convicted of a second or subsequent DUI offense, the court does not have the discretion to grant an expungement. It is important to note that if your DUI conviction is expunged, the Washington State Department of Licensing may still include the DUI conviction on your driving record.
