What is the difference between DUI and DWI in the state of Texas?

In the state of Texas, DWI (Driving While Intoxicated) and DUI (Driving Under the Influence) are two different charges. While they are similar, they have quite a few differences. A DWI applies to drivers who have a Blood Alcohol Content (BAC) of .08 or higher and are considered to be “intoxicated” by the state of Texas. This can result in fines, license suspension, and even possible jail time. DUI is defined as operating a vehicle while under the influence of drugs or alcohol, but this does not require that the person’s BAC is .08 or higher. If a police officer has reasonable suspicion that a driver is operating a vehicle under the influence of drugs or alcohol, even if the BAC is not .08 or higher, the driver can be charged with a DUI. A person who is charged with a DUI can face various penalties such as fines, license suspension, and even jail time. While DWI and DUI can be similar in some aspects, the two charges have their differences in Texas. DWI applies to drivers who have a BAC of .08 or higher, and DUI applies to drivers who are operating a vehicle while under the influence of drugs or alcohol, regardless of BAC.
