What is the difference between DUI and DWI in the state of Texas?

In Texas, Driving Under the Influence (DUI) and Driving While Intoxicated (DWI) are two separate offenses with different legal penalties. DUI is a Class C misdemeanor and is less serious than a DWI, which is a Class B misdemeanor. The main difference between the two offenses is the amount of alcohol that must be present in the driver’s system for an arrest. For DUI, the limit is 0.08% blood alcohol concentration (BAC).
