Can I cancel an administrative license suspension?

Yes, you can cancel an administrative license suspension in North Dakota. This is done by filing a petition for review with North Dakota’s Department of Transportation (NDDOT). The NDDOT will review the petition and determine if the license suspension should be cancelled or not. To be eligible for a license suspension cancellation, you must meet certain criteria. First, your suspension must have occurred within the last six months. Second, you must demonstrate “exceptional circumstances” that warrant license reinstatement. Finally, you must meet all the terms of your license suspension such as paying any fines and court costs and successfully completing any alcohol or substance abuse treatment courses. If your petition is accepted, you will be given a limited driver’s license that will allow you to drive for employment, educational, medical, and court-related purposes. You will also have to pay a $250 fee. It is important to note that if your license suspension was issued due to a DUI conviction, you will not be able to cancel the suspension. In this case, you must serve out the duration of your suspension before your license will be reinstated.
