What is the penalty for a third DUI conviction?
In South Carolina, the penalty for a third DUI conviction is severe. A third conviction within 10 years comes with a fine of at least $2,500, a minimum of 1 year in prison, and a minimum of 3 years’ suspension of the offender’s driver’s license. The offender may have to complete an alcohol and drug safety action program, attend a victim’s impact panel, and serve community service as well. The offender may also have to pay additional fees to the DMV and install an ignition interlock device in his or her vehicle. The offender will also face many other consequences, such as having difficulty getting a job or obtaining certain types of insurance. In addition, the offender’s criminal record will contain a permanent record of the conviction and registration as an Alcohol and Drug Safety Action Program participant.
