Can a DUI be expunged from my record?

In North Dakota, a DUI cannot be expunged from your criminal record. Once a DUI has been entered on your record, it will remain there unless you are able to qualify for a pardon or an order of expungement from the North Dakota Supreme Court. The qualifications for a pardon or an expungement are very specific and difficult to obtain. In order to receive a pardon, the individual must have the approval of the governor. For an expungement, the individual must have a good reputation, have no subsequent criminal convictions within 5 years of the date of the conviction, and demonstrate that there are no compelling reasons not to grant an expungement. Having a clean criminal record is important for many aspects of life, such as finding a job or housing, however, in the case of a DUI conviction in North Dakota, it is not possible to have the record expunged. Even with a pardon or expungement, the DUI still remains part of the individual’s permanent record and may still be reported to certain employers and organizations. Therefore, while it is not possible to have a DUI expunged from your record in North Dakota, there may be other options available to you if you are trying to improve your criminal record. You should speak to an attorney for more information about what options may be available to you.
