What are the consequences of a 2nd DUI in the state of Florida?
In the state of Texas, the consequences of a second DUI are very serious. Depending on the severity of the offense, the court may impose a wide range of punishments. Generally, if the DUI offense is a second violation within a 10 year period, the punishment is much more severe than a first offense. The punishment for a second DUI may include a jail sentence of up to 180 days or more, a fine of up to $4,000 and/or an annual surcharge of up to $2,000 for three years for the first time offense. If it is determined by the court that the person drove while intoxicated for a second time, a longer jail sentence of up to one year may be given, as well as a fine of up to $10,000 and/or an additional annual surcharge of up to $4,000 for three years. Additionally, the person may lose their driver’s license for up to two years. The person may also be required to attend an alcohol education program and have an ignition interlock device installed on their vehicle. This device requires the driver to blow into it for breath alcohol content verification before the car can be started. The consequences of a second DUI are severe and should be taken seriously.
