What are the consequences of a 2nd DUI in the state of Washington?
A person who is convicted of a second DUI offense in the state of Washington will face substantially harsher penalties than those who are convicted of their first DUI. A second DUI offense is a gross misdemeanor and carries a mandatory minimum of thirty days of jail time. In addition, a person may have their license suspended for at least two years and may be subject to a maximum fine of $5,000. The court may also order certain other measures, such as completing an alcohol abuse assessment and engaging in treatment, if necessary. Additionally, the court may impose a variety of additional sanctions such as community service, a longer suspension of driving privileges, installation of an ignition interlock device on the vehicle, fines, and even further jail time. In addition to these statutory penalties, there are also many non-legal consequences of a second DUI conviction. These consequences could include higher insurance rates, social stigma, and lost time from work due to jail time and/or court appearances. When facing DUI charges, a person should immediately consult a qualified criminal defense attorney who can provide advice and guidance about the most effective defense strategies to use and what penalties may be imposed if a conviction is entered. With the advice and guidance of qualified counsel, a person may be able to work toward a favorable outcome in their case.
