What is the difference between a drug DUI and an alcohol DUI?

DUI stands for Driving Under the Influence, and applies to driving while impaired by either drugs or alcohol. In Washington, both are considered criminal offenses, but the exact details and consequences of a drug DUI versus an alcohol DUI can vary. A drug DUI occurs when a driver has any amount of an illegal drug in their body while driving. Even prescription medications can be grounds for a drug DUI in some areas. Penalties for a drug DUI can include license suspension or revocation, fines, community service, and even jail time. An alcohol DUI happens when a driver has a blood alcohol concentration (BAC) over the legal limit of 0.08%. A BAC of 0.15% or higher can result in stiffer penalties, including longer suspension or revocation of a driver’s license, larger fines, and the possible installation of an Ignition Interlock Device (IID). An IID requires the driver to submit a breath sample before the car can start. The main difference between a drug DUI and an alcohol DUI is the testing used to detect their presence in the body. Drug DUIs rely on a blood test or urine test that looks for traces of drugs in the body. An alcohol DUI, however, relies on a Breathalyzer test which measures alcohol levels in the breath. In Washington, a DUI conviction can lead to severe consequences regardless of whether it involves drugs or alcohol. It’s important for all drivers to be aware of their limits and to never drive while impaired.
