What is an ignition interlock violation?

An ignition interlock violation is when a person drives a vehicle with an ignition interlock device installed and the device registers a blood alcohol concentration (BAC) that is 0.02% or higher. In California, if a person has a DUI charge on their record, they are required to install an ignition interlock device on their vehicle in order to be allowed to drive. The device prevents a vehicle from starting if a breath test registers an alcohol concentration that is over the legal limit (in California, this limit is 0.08%). If a person attempts to drive a vehicle with the ignition interlock device installed and the device registers a BAC that is higher than 0.02%, it is considered an ignition interlock violation. This violation can result in a number of serious repercussions, such as fines, jail time, additional license suspension, and other penalties. Additionally, the negligent party may be required to obtain an alcohol treatment program and be subject to more frequent BAC tests. In California, it is illegal to drive with any detectable amount of alcohol in your system. Thus, it is important to always remain below the legal limit of 0.08% to avoid any possible ignition interlock violation and its associated consequences.
