What are the penalties for a DWI conviction?

In Nebraska, the punishments for a Driving While Intoxicated (DWI) conviction vary depending on the severity of the offense and the person’s prior criminal history. Generally, a first-time DWI conviction may result in a maximum of up to three years of probation, a $500 fine, two days to one year in jail, the completion of an alcohol and drug education program, and the installation of an ignition interlock device. For a second DWI conviction, the penalties become more severe. A second-time offender may face a minimum of 30 days in jail, a $500 minimum fine, up to a $10,000 fine, up to five years probation, an alcohol and drug education program, and the installation of an ignition interlock device. For a third or subsequent DWI conviction, the penalty can be even more severe. A third-offender may face a minimum of 90 days in jail, a $1,000 minimum fine, up to a $25,000 fine, up to 15 years probation, the completion of an alcohol and drug education program, and the installation of an ignition interlock device. It is also important to note that these penalties may be enhanced if the DWI results in serious bodily injury or death. In addition to the penalties listed above, a person who has been convicted of a DWI may also face a driver’s license suspension, an increase in car insurance premiums, and the possibility of having their vehicle confiscated.
