What should I do if I’m pulled over for suspected drunk driving?
If you are pulled over on suspicion of drunk driving in New Mexico, it is important that you cooperate with the police officer and follow their instructions. The officer may conduct a field sobriety test to determine if you are under the influence of alcohol. This may include asking you to walk in a straight line, count, and other tests. Once the officer has determined that you are under the influence of alcohol, they may request a breath sample. Refusing to take the breath sample will result in an automatic six-month license suspension. If the officer does determine that you are over the legal limit, they will arrest you for Driving While Intoxicated (DWI). Your vehicle may then be towed and you will be taken to a police station for further processing. However, you do have rights. It is advised that you remain calm and contact a lawyer as soon as possible. You also have the right to remain silent and it is advised not to answer questions or make any statements until you have spoken with a lawyer. In New Mexico, DWI is a serious offense and can have serious consequences. For a first time offense, the penalties can include fines, jail time, and license suspension. It is important to familiarize yourself with the laws in your state to avoid potential penalties.
