Is there any way to get around an administrative license suspension (ALS)?
In Washington, an Administrative License Suspension (ALS) occurs as a result of failing or refusing to take a breath or blood test for intoxication when stopped for a suspected DUI. An ALS can be a difficult and costly punishment, however, there are a few ways to potentially get around an ALS. The first way is to challenge the suspension within 20 days of the arrest. If the suspension is challenged, a hearing will be scheduled, and an officer from the Washington State Department of Licensing (DOL) will decide whether or not to revoke the suspension. If the suspension is revoked, the driver will not have to endure an ALS. Another option is to obtain an ignition interlock device license. This type of license is available to drivers who have had their license suspended due to a DUI offense. It requires drivers to blow into the device before they can start their vehicle. It also requires the driver to blow into the device at random intervals while they are driving. An ignition interlock device license is valid for the length of the suspension and can be used to drive legally throughout the duration of the suspension. Finally, a driver may be eligible for a hardship permit. This type of permit may be issued to drivers who cannot wait for the suspension period to end before needing to drive. Hardship permits allow drivers to drive for specific reasons only, such as commuting to and from work. A hardship permit may be requested from the DOL, however, it must be approved before it can be issued. Overall, an ALS can be a difficult and costly suspension to deal with. If a driver does receive an ALS, they should know their options to potentially get around the suspension.
