How do I know if I’m legally intoxicated?

In Nebraska, a person is legally intoxicated if they have a blood alcohol content (BAC) of .08 or higher. This means that a person’s blood has 0.08 percent or more of alcohol in it, which can cause impairments in coordination and judgment. In order to know whether or not one’s BAC is legally impaired, they must take a test. The most common test used to measure blood alcohol content is known as a breathalyzer test. This test involves measuring the amount of alcohol in a person’s breath. Typically, a police officer will ask a person to take a breathalyzer test if they suspect the person of being under the influence. If the results of the test show that the person’s BAC is at or above .08, they will be charged with Driving While Intoxicated (DWI). It is important to note that even if a person’s BAC is under .08, they can still be charged with a DWI if the officer determines that the person is impaired. That is why it is important to know how alcohol affects you and to know your limits. If you are unsure of your ability to safely operate a motor vehicle, it is best to find another way home.
