How do I know if I’m legally intoxicated?
In the state of Washington, it is illegal to operate a motor vehicle with a blood alcohol concentration (BAC) of .08% or above. This is legally considered “intoxicated” under state law. However, even a BAC of .05% or above can result in a DUI (driving under the influence) charge. This is because you are considered to be impaired and dangerous behind the wheel at these lower levels of intoxication. The best way to know if you’re legally intoxicated is to use a breathalyzer test, often conducted by the police. If you are found to have a BAC of .08% or above, then you are considered legally intoxicated under Washington law. In addition to a breathalyzer test, the police can also gather evidence including physical observations or other tests to determine whether someone is legally intoxicated. If you are found to be legally intoxicated, you will be charged with a DWI (Driving While Intoxicated) criminal offense. This is a serious charge and can include jail time, fines, suspension or revocation of your driver’s license, community service, counseling, and other penalties. It is best to always make sure you are sober before getting behind the wheel of your car. If you think you may have had too much to drink, it is best to take alternative transportation to get home such as a taxi, Uber, or public transportation.
