What is the legal limit for driving under the influence of drugs (DUID)?
In Texas, any amount of drugs in the body found above a zero tolerance (0.00) level is considered a Driving Under the Influence of Drugs (DUID) offense. This means that if a test whatsoever finds any amount of drugs in the system, the person is assumed to be driving while impaired, and can be charged with a DWI. It is important to note that while the Blood Alcohol Concentration (BAC) limit for legal purposes is .08, the limit for DUID is 0.00. This means that even if the person is not over the legal BAC limit, the presence of any detectable amount of drugs in the body can still be considered as driving under the influence. For this reason, if a person is suspected to have drugs in their system, they can be subjected to blood or urine tests and charged with a DUID if any drugs are found present. Traces of illegal drugs, prescription drugs, and even over-the-counter drugs can all be used as evidence to convict someone of DUID. Overall, the legal limit for DUID in Texas is zero tolerance and any amount found in a person’s system can result in a DWI charge. Depending on the amount of drugs found in the system, a person may face criminal penalties or license suspension if convicted of the offense.
