Is a DWI expungeable from my criminal record?

In Hawaii, a DWI (Driving While Intoxicated) is a criminal offense and is typically placed on a person’s criminal record. However, depending on the specific circumstances of the DWI, it is possible to have the record expunged or sealed. An expungement or sealing of a record will completely remove all information of the DWI from the court and law enforcement records, leaving no trace that a DWI was ever committed. In order to have a DWI expunged, you must meet certain criteria and seek an expungement from the court. Generally, you must have no prior criminal history, the DWI must have involved no other charges, and the charge must have been dropped. Seeking an expungement of a DWI from your criminal record can be difficult, especially since the laws surrounding DWIs are complicated. Additionally, all requests are subject to the courts discretion. However, if you are able to prove to the court that the circumstances surrounding the DWI meet the criteria set forth by the state, there is a good chance that your record can be expunged or sealed. It is important to note that not all DWIs can be expunged or sealed. That being said, you should talk to a lawyer to determine if your DWI is eligible. Doing so will help you determine the best way to fight for a clean criminal record.
