Is there any way to get out of a DWI conviction?
In Arkansas, there are a few ways to get out of a DWI conviction. First, if the court finds that the evidence is not sufficient to prove guilt beyond a reasonable doubt, then the driver may be found not guilty. Another option is if an attorney can prove that the traffic stop was illegal due to a violation of the driver’s constitutional rights. The driver may also be found not guilty if the breathalyzer test results were not valid for some reason, such as the machine was not properly calibrated. In some cases, the driver’s attorney may be able to negotiate with the prosecutor and enter into an agreement that leads to the dismissal of the charges. This agreement typically involves the driver entering into a plea agreement in which they plead guilty to a lesser charge in exchange for a lighter sentence. Finally, if the driver completed an alcohol education or rehabilitation program, attended court-ordered counseling, or otherwise showed signs of contrition, the court may consider reducing the sentence or dismissing the charges outright. In general, all of these options depend on the circumstances of the case and the discretion of the judge.
