Can I attend an alcohol treatment or education program to avoid a DWI conviction?

In the state of Washington, attending an alcohol education or treatment program may be able to help you avoid a DWI conviction. Depending on the specifics of your case, the court may consider granting you a deferred prosecution or a deferred sentence if you are willing to complete a substance abuse treatment, educational or other program before the case is concluded. In some cases, you may be able to enter a plea of “guilty, with treatment” in exchange for a probationary period and the possibility of reduced or deferred sentencing. The court may then require you to complete treatment, educational or other programs before deciding whether to dismiss the charges or impose any sentence. In addition, depending on your individual situation, the court may order that you participate in a drug or alcohol evaluation to determine if you are in need of treatment or education about the dangers of substance abuse. If you are found to be in need of treatment, the court may then order you to attend an appropriate program and complete it successfully before sentencing. In some cases, the court may even require a period of abstinence from alcohol, or supervision of your drinking habits, in order to avoid a conviction or to reduce a sentence. While these programs are not always available, they are an important way to demonstrate to the court that you are willing to take responsibility for your offense and work towards a healthier lifestyle.
