What is the legal limit for driving under the influence of marijuana (DUIM)?

In Nebraska, the legal limit for Driving Under the Influence of Marijuana (DUIM) is 5 nanograms of active tetrahydrocannabinol (THC) per milliliter of blood. THC is the main psychoactive component of cannabis, which is what gives a person the sensation of being “high” when ingested. It is important to note that the legal limit is not a measure of impairment – an impaired driver could still operate a vehicle with less than 5 nanograms of THC in their blood. However, if a driver has more than 5 nanograms of THC in their system, they can be charged with DUI, and the Nebraska State Patrol is currently using blood tests to measure the THC levels of motorists they suspect of being impaired. Additionally, if a driver tests positive for more than 5 nanograms of THC in their system, they can also be held criminally liable. While Nebraska does not have a “zero tolerance” law, meaning that any amount of THC in a driver’s system is enough to find them guilty of DUIM, it does still have strict penalties for those who are found guilty of operating a vehicle under the influence of marijuana. These penalties can include both fines and jail time, depending on the severity of the violation.
