What is education law?
Education law is a branch of law specifically dealing with education. It covers a wide range of topics related to the administration and functioning of educational institutions. In North Carolina, education law covers the requirements for obtaining a teaching license, the rights of students, the duties of teachers and principals, and the legal issues related to the sale and financing of school property, among other topics. Education law is most often found in the U.S. Constitution, state statutes, and regulations. In the states, such laws are found in the Education Code, which contains regulations governing all aspects of education within that state. In addition, the federal government regulates some aspects of education, including, for example, civil rights and funding for education-related programs. Education law is constantly evolving, as it is shaped by the courts and legislatures. Cases involving the rights of individuals can also have a significant impact on education law. For example, the U.S. Supreme Court’s decision in Brown v. Board of Education compelled states to adopt desegregation plans, resulting in constitutional changes in public education. In North Carolina, a number of statutes, regulations, and other legal documents govern education law. For example, the North Carolina State Board of Education is responsible for making rules and regulations related to the education of children in the state. In addition, the State Board of Education provides guidance to local school districts, colleges, and universities on education-related matters.
