What is the law on bullying in schools?
In Florida, there are laws in place to protect individuals from bullying in schools. The Jeffery Johnston Stand Up for All Students Act (2009) was created to protect pupils from being bullied or harassed by other students. This law requires public schools and government-run private schools to adopt a comprehensive policy to prevent and respond to bullying, harassment and cyberbullying. The policy must include the definitions of bullying and cyberbullying, reporting procedures, clear consequences, and must also provide for the education of staff, pupils, and parents on how to identify, prevent, and respond to such behaviors. There must also be a protocol in place to communicate incidents to the parents of pupils involved in the bullying. Schools must also provide counselors or social workers to help victims of bullying, along with offering training to all staff and students on bullying prevention and recognition. The law also includes protection for victims of bullying who decide to take action against those who are bullying them. Victims are entitled to a safe school environment free from harassment and intimidation and authorities must be aware of any unfounded retribution or disciplinary action taken against victims. Overall, Florida has a duty to ensure the safety and security of its students by addressing any reports of bullying and taking action when necessary.
