What is the process for mediating disputes in the school setting?

In Tennessee, disputes between students, parents, and/or teachers can often be mediated in the school setting. Mediation is a process in which a neutral third party, known as a mediator, facilitates communication between the parties involved in a dispute to promote understanding and find a resolution. The mediator does not decide the outcome of the dispute, but rather works to understand the parties’ perspectives and encourages them to work together to find a mutually agreeable solution. At the beginning of the mediation process, the parties involved meet with the mediator. During this meeting, the mediator will explain the process, the expectations of the parties, and any rules of conduct. Then, the mediator typically meets with both parties separately before the group meets again to discuss the dispute. The mediator can help identify areas of agreement and disagreement, summarize any agreements, and provide the parties with options for resolution. The mediator will also work to ensure that all sides of the dispute are heard and respected. Although the mediation process can take several meetings to complete, it is typically less costly and less time-consuming than filing a lawsuit. Furthermore, it often allows the parties involved to find common ground, develop a plan for resolution, and ultimately achieve a satisfying outcome.
