What is an emergency guardianship?
An emergency guardianship is a legal process in Kansas that someone can use if they need to appoint a guardian immediately for an elderly person. This is sometimes necessary if the elderly person is unable to take care of themselves or if their health is quickly declining. The emergency guardianship process is used when a regular guardianship is not an option due to the time constraints or the complexity of the situation. When filing for an emergency guardianship, the petitioner must provide the court with documentary evidence that proves why an emergency guardianship is necessary. This could include a doctor’s evaluation of the elderly person’s health, a statement from the patient, or a declaration in support of the emergency guardianship. The court may also require that the petitioner show that the elderly person has been properly served with the legal documents. Once the guardian is appointed, they are expected to act in the elderly person’s best interest, including making decisions about medical care, healthcare decisions, and managing assets. The guardian may also be responsible for providing an annual report to the court outlining the elderly person’s care. An emergency guardianship is a useful tool for those who may need to act quickly to protect an elderly person’s life or health. However, it should only be used as a last resort when all other options have been exhausted.
