What are the requirements for special elections?

In Montana, special elections are held when necessary, such as when an elected official resigns. These elections are typically held in the middle of the year, between a primary and a general election. In order for a special election to be held, the Governor of Montana must issue a proclamation. This proclamation must be in accordance with the laws specified in Title 13, Chapter 8 of the Montana State Code. In this statute, it outlines the procedure and requirements for special elections in Montana. The statute states that the special election will be held no earlier than two weeks after the proclamation is issued and no more than six weeks after. The election must be held in the county where the vacancy arose, unless the statute states otherwise. The statute also requires that the Governor of Montana appoint a secretary for the special election and file a notice of the election with the county commissioners. The county commissioners must then publish the notice in a local newspaper and mail a copy to each precinct. The Secretary of State must also provide the election materials necessary for the special election, which include voting machines, ballots, and other necessary materials. In order to run in the special election, a person must file a Declaration of Candidacy with the Secretary of State at least 56 days before the election. The candidate must also pay any required fees in order to be on the ballot. Finally, those who want to vote in the special election must be registered to vote at least 30 days before the election.
