Is there a required notice period for terminating an employment contract?

In Virginia, any employer who wishes to terminate an employment contract must provide employees with written notification. The notice period required for terminating an employment contract depends on two factors: whether the contract is classified as indefinite or definite, and if the contract is classified as a Collective Bargaining Agreement (CBA). In the case of an indefinite contract (a contract that does not have a specified duration or end date), no notice period is required for termination. The employee can be terminated at any time without prior notification. In the case of a definite contract (a contract that has a specified duration or end date), the employer must provide the employee with written notification at least 30 days before the end date of the contract. In the case of a CBA, the notice period depends on the terms of the collective bargaining agreement. Each CBA is unique and the notice period must be spelled out in the agreement. In general, there is no required notice period for terminating an employment contract in Virginia, but employers must always provide written notification of any termination of a definite contract or a CBA.
