Are employers legally obligated to provide their employees with a pension scheme?

In Washington, employers are not legally obligated to provide their employees with a pension scheme. This means that employers have the option to either offer a pension plan to their employees or not. There may be circumstances when an employer is obligated to offer a pension plan under a collective bargaining agreement, but these circumstances are not often seen. However, employers do have a responsibility to comply with any applicable state and federal regulations regarding retirement plans, such as the Employee Retirement Income Security Act (ERISA) and the Internal Revenue Code. Under these regulations, employers are required to provide certain types of retirement plans and may be subject to penalties if they do not comply. In short, while employers may choose to provide a pension plan to their employees, it is not necessarily a legal obligation. Employers must, however, comply with any applicable retirement plan laws and regulations.
